Nothing to Worry, Nothing to Cheer - Union Cabinet Approves Revival of BSNL and MTNL


Dear Members,

The Union Cabinet has approved on 23.10.2019 the Revival Plan of Telecom Sector CPSUs, i.e. BSNL and MTNL. The Salient Features of Revival Plan are as under, -

a.           Allocation of 4G Spectrum/Capital Infusion of Rs. 20000+Crores:
4G Spectrum Allocation is mere an administrative action. The spectrum allocation shall be funded by capital infusion, i.e. book adjustment, which means there shall be no cash inflow to the CPSUs. Whatever be the cost of spectrum shall be the amount of capital to be infused.

b.           Sovereign Guarantee for Long Term Bonds of Rs. 15000 Crores:
The Union Government to stand as Guarantor for Long Term Debt Bonds. The funds of Rs. 15000 Crores to be raised by issuing bonds shall be utilised partly for debt restructuring (i.e. squaring-off of existing loans) and partly for Capex/Opex (i.e. Network Expansion and Working Capital). In nutshell, the meagre amount of Rs. 15000 Crores is unlikely to result in a sufficient cash inflow.

c.           Voluntary Retirement Scheme for Staff:
The plain reading of plan suggests that the Union Government will bear the cost of VRS (i.e. Gratuity, Pension and Commutation and Ex-gratia) through Budgetary Support. BSNL has already been paying Pension Contribution to Union Government in lieu of which Gratuity, Pension and Commutation is otherwise payable. The only crux is ex-gratia, the cost of which Union Government will hopefully bear. There seems nothing for BSNL Recruited Employee, who are in the zone of VRS. We therefore insist that as a part of VRS Plan the liability for provisioning of 30% Superannuation Benefits for BSNL Recruited Employees since 01.10.2000 must be created in the books of BSNL.

d.          In-principle Merger of BSNL and MTNL:
The move of merging BSNL and MTNL is expected to ensure the synergy gain unlike the merger of Air India and Indian Airlines which met the fate of hard landing. We also hope that the HR related issues will also be synchronised, before going ahead with the proposal of merger, firstly by upgrading the pay scales of BSNL at par with those of MTNL.

e.           Monetisation of Assets:
The monetisation of assets to raise the resources for retiring debt, servicing bonds, network upgradation, expansion and meeting the operational fund requirements. We insist that the land assets are capital assets and its sale proceeds must be utilised only for generation/acquisition of capital assets. Thus, there is no justification for using their proceeds for recurring expenditure. Further, all the assets, which have already been transferred by BSNL to various Government Departments and Bodies since 01.10.2000, should also be included in monetisation plan. The monetisation of assets must take place in very transparent manner through auctioning route.

In terms of procedure as contained in Rule 5.b.i. of Rules and Regulations of BESA, the Annual General Meeting of Central Headquarters under Rule 5.a.i. is hereby notified to be held at New Delhi on 12th and 13th Day of October 2019 to deliberate and consider the following agenda,

Illegal Collection by SSA/BA Heads

Dear Members,

For quite sometimes, your association has been observing that some of the SSA/BA heads are making illegal collection of money from employees in the name of meeting business expenditures, whereas BSNL Corporate Office has never authorised them to make any such collection from employees. The SSA/BA heads are assigning collection targets through informal WhatsApp groups and their kingpins are set in motion to achieve those targets. Though the contribution is stated to be voluntary, but non-contributing employees are kept in the bad books of such SSA/BA heads and thereafter they are harassed. Many letters were making rounds in different WhatsApp Groups, purported to have been issued by GMTD Vijayawada, GMTD Pathankot, GMTD Bulandshahar, etc. and most recently by Sh. Sudeep Kumar, GMTD Karnal. The collection so made from employees is not accounted for in the books of BSNL. None other than Sh. Sudeep Kumar knows whether the amount so collected from employees is being actually spent for BSNL or not? Whether due procurement procedure is followed or not? Whether quality assurance checks are in place or not? Further, the collection so made and spent is not subject to any internal check, internal control or audit.

Said collection is being made in stringent violation of, -
a.   Article 81 of BSNL’s Articles of Association.
b.   Section 166 of Indian Penal Code 1860.
c.    Rule 12 of Central Civil Services (Conduct) Rules 1964.
d.   Rule 5 (15) of BSNL CDA Rules 2006.
e.    Section 13 of Prevention of Corruption Act 1988.

Therefore, in light of law and facts stated hereinabove, your association has written to higher-ups in DOT, BSNL and Vigilance to hold an inquiry and bring matter to justice.

Fair Enquiry into Crinimal Complaint against the family members of Sh. Banwari Lal Varshney


At the outset we appreciate the decision of government, whereby Sh. Banwari Lal Varshney (ITS-1983) has been entrusted with the additional charge of Director (Enterprise Business) BSNL. But, for the facts as came to our notice and stated hereinafter, it is apprehended that the decision of entrusting Sh. Banwari Lal Varshney (ITS-1983) with the additional charge of Director (Enterprise Business) would be detrimental to the interests of BSNL as well as its honest officers.

The wife and brothers/sister-in-law (hereinafter jointly referred to as ‘owners’) of Sh. Banwari Lal Varshney jointly own a building in Bareilly (UP), which is lent-out to BSNL. For quite sometimes, the owners were disputing the rent amount. Finally last year, the owners illegally locked the building and took possession of BSNL assets worth crores of rupees lying there. Thereafter, the owners secretively dislocated these BSNL assets to unknown place. Following this incident, BSNL lodged a FIR in Prem Nagar Police Station of Bareilly against the owners for committing offences under Section 353 IPC (Assault or criminal force to deter public servant from discharge of his duty), Section 379 IPC (Theft), and Section 406 IPC (Criminal breach of trust). Since the owners are influential persons of Bareilly, Police didn’t take any action and finally BSNL had to approach Hon’ble Allahabad High Court by filing Criminal Miscellaneous Writ Petition, which directed the State Police to conclude the investigate and submit the report before Magistrate. Thus, the matter is now subjudiced before the Magistrate Court of Bareilly.

In view of stated facts, it is apparently clear that there is conflict of interest in entrusting the additional charge of Directorship to Sh. Banwari Lal Varshney, who, being Managing Director, is likely to influence and affect the decision of litigant officers acting on behalf of BSNL so as to tilt the matter in favour of his wife and brothers/sister-in-law, more particular at the juncture when BSNL has also filed Protest Petition against the findings of State Police before the Magistrate Court of Bareilly.

In this matter, the instance of Income Tax Evasion and fraudulent enhancement of rent with retrospective effect has also come to our notice. This Association is trying to get the relevant papers so that the whole matter could be brought to justice.

Therefore, in light of facts stated hereinabove, it is requested to. –
1.              Review the decision cited under reference above;
2.              Hold an independent departmental inquiry into the matter, where this Association world be able to provide crucial evidence against miscreants: and also
3.              Restrain Sh. Banwari Lal Varshney immediately from occupying the post of Director (Enterprise Business) till the matter is finally decided by the competent court.

BESA Views on strike called by AUAB

मैं आपसे सहमत हूँ कि BSNL मैनेजमेंट बहरी और गूंगी है।।। ये स्ट्राइक 4G Spectrum के लिए हो रही है या 3rd PRC के लिए??? ये स्ट्राइक BSNL के भविष्य के लिए नहीं, बल्कि भविष्य को ख़तरे मे डालने के लिए की जा रही है, और वो भी उन लोगों द्वारा जो BSNL से रिटायर हो चुके हैं।।। अगर भविष्य की ही बात है तो पहले उन लोगों को BSNL से बाहर करो, जिसमे मैं भी आपके साथ हूँ, जिन्होंने 18 सालों से BSNL पर कब्ज़ा कर रखा और BSNL को अपनी कॉलोनी बना रखा है।।।

मैं ये मानता हूँ कि हमे भी 3rd PRC मिलना चाहिए।।। अगर ITS को मिला है तो हमे क्यों नहीं??? फिर 5% क्यों, 15% क्यों नही??? इनका कारण है कि पेंशन डिलिंकिंग के बाद पेंशनर्स को 15% फिटमेंट ही दिया जाएगा।।। तो मारा कौन गया, हम जैसे BSNL रेकरुइटिस।।।

मेरे को कुछ मेंबर्स फ़ोन करके पूछ रहे हैं कि BESA का क्या स्टैंड है??? BESA का स्टैंड बहुत क्लियर है पहले E2 और 30% SAB, फिर 3rd PRC...

जब पेंशन डिलिंकिंग का आर्डर आ जायेगा, AUAB की स्ट्राइक भी बंद हो जाएगी।।। आज 13 सालों बाद भी E2 अप्रूव नही हुआ है, ये SNEA और AIBSNLEA की देन है, जो कैस्केडिंग पर अड़े रहे।।। और नुकसान हुआ BSNL रेकरुइटिस का।।।

*इनको अपनी पेंशन रीविजन नज़र आती है पर हमारा 30% SAB नही???*

इसलिए अपना विरोध दर्ज करो।।।

Fallout of AUAB and Standard E2/E3 Pay Scales


Dear Members,

As you are aware that so called majority associations and unions (including SNEA, AIGETOA and AIBSNLEA, etc.) under the umbrella of AUAB, are misleading the BSNL Recruited Executives on the pending issues of 2nd PRC, more particularly Standard E2-E3 Pay Scales w.e.f. 01.01.2007. Therefore, we are here to recapitulate and reiterate the true facts of Standard E2/E3 Pay Scales.

On 03.12.2018, AUAB had a meeting with Sh. Manoj Sinha, Hon'ble MoSC on various issues pertaining to BSNL employees. But, these campaigning associations misled the mass, especially post 2007 recruitees, that Hon'ble Minister had directed Secretary DoT to process E2/E3 at earliest. See the screenshot of AIGETOA website. Whereas, the shocking truth came out when the minutes of meeting were issued, which clearly showed that the issue of Standard E2/E3 Pay Scales was never ever taken-up before Hon'ble MoSC and AUAB gave false as well as political statement to keep its members afloat. AIBSNLEA sung altogether different song on Standard E2/E3 Pay Scales, whereby it demanded up-gradation of all scales, which factually led to the delay of good 12 years in finalisation of Standard E2/E3 pay scales w.e.f. 01.01.2007. Now, comes the turn of so called majority association SNEA, which is hell-bent on causing perennial loss to entire executive fraternity by demanding lower Standard E1 pay scales + 5 increments w.e.f. 01.01.2007.

The bluffs of these associations, on the issue of Standard E2/E3 Pay Scales, are apparent from the fact that DoT has given altogether different counter reply in Hon'ble Chandigarh CAT and that too after the AUAB meeting dated 03.12.2018 with Minister Sahib! DoT is still justifying its stand which led to issuance of arbitral and capricious Presidential order dated 28.03.2017. See the Counter Reply given by DoT before Hon'ble Chandigarh CAT.

Dear Members, it is reiterated and assured that finalisation of E2/E3 Standard Pay Scales w.e.f. 01.01.2007 is the only solution to this stalemate. And, we are about to achieve it through OA already filed before Hon'ble Chandigarh CAT. The Counter Reply given by DoT before Hon'ble Chandigarh CAT is going to bite dust there. We already apprised all of you that AUAB is mere a platform to achieve the things for executives already retired or about to retire. And, expecting AUAB to do something for BSNL Recruited Executives is just a mischief.

It is not Madhya Pradesh’s Sand Mafias alone…



Dear Members and Colleagues,

Apropos of captioned issue, it is wrong that Madhya Pradesh’s Sand Mafias alone take the State Officers into task. Yes, this is the turn of Telecom Mafia, not only in Madhya Pradesh, but elsewhere too. For some sometimes, the Telecom Mafias, disguising as Telecom Contractors, have been steering the HR issues of BSNL, whereby it is none difficult for them to get the officers transferred at the snap of their fingers. Latest in this series, is the case of Sh. R P Shahu, SDE (Waidhan), Madhya Pradesh.

It has come to our notice through WhatsApp and other sources that one Telecom Contractor named M/s Suman Engineering Works (who is stated to have close nexus in Ministry of Communication) has been executing and supervising OFC projects for Reliance Jio Infocomm Limited in the Singrauli Area of Siddhi SSA of Madhya Pradesh. While executing these projects, said contractor damaged the OFC Cable of BSNL at different locations. Sh. R P Shahu, SDE (Waidhan), being in-charge of maintaining the OFC Cable, issued Demand Note to the tune of Rs. 1274000.00 to said contractor on 05/12/2018. Disgruntled therewith, said contractor used his influence in the Ministry, probably Sh. Saket Kumar (IAS) PS to Hon’ble Minister of State for Communication, and got Sh. R P Shahu transferred from Siddhi SSA to Jhabua SSA on 06/12/2018 and also got him relieved immediately without any substitute. This staking revelation has been made by CGMT Madhya Pradesh in his conversation with Sh. R P Shahu.

Notably, Sh. R P Shahu had been serving his soft tenure at Siddhi SSA since January 2016 and on the completion thereof he was eligible either to continue there or to get choice station at the cost of BSNL. But, BSNL shattered its own transfer policy to pacify the fury of its honchos in Ministry. Admittedly, Jhabua SSA is also a soft tenure station. Sh. R P Shahu shall complete his soft tenure at Siddhi and Jhabua within next 30 days and thereafter he shall be again eligible for his choice transfer at the cost of BSNL. After all what is BSNL going to achieve by transferring Sh. R P Shahu twice in short span of 30 days that too at the cost of BSNL!

It is apparently a disgusting matter, whereby an Upright Officer like Sh. R P Shahu, who was protecting the interest of BSNL, has been transferred to appease Reliance Jio! This is nothing but an unpleasant example set by BSNL Management for its officers to showcase the consequences of being honest and upright.

Thus, the BSNL Management and Secretary DOT are requested to be transparent on this issue and, -
1.               Maintain status quo ante, i.e. the status as on the date before the issuance of transfer order of Sh. R P Shahu to Jhabua SSA;
2.              Conduct an independent inquiry into the incident as to how the transferring authority bore upon himself the external pressure to adversely affect the interest of BSNL, whereby the handler in the Ministry also, through Sh. Anupam Srivastav CMD and Smt. Sujata Ray Director (HR), obstructed an officer from discharging his duties.
3.               Ensure the recovery of Damages from M/s Suman Engineering Works for damaging the OFC Cable of BSNL;
4.               Such other things to boost the morale of BSNL officers with the assurance that such an imprudent incident would not occur in the future.





जानिए क्या है E2 और E3 पे-स्केल्स की सच्चाई ???

साथियो,

ऊपर दिए गए विषय की जानकारी देने के लिए मैं ये लेख लिख रहा हूँ, जिसके माध्यम यह भी बताना चाहता हूँ कि किस तरह बड़े बड़े संगठनों ने BSNL Recruited Executives का शोषण किया।

01.10.2000 में जब DTS और DTO को BSNL बनाया गया, तो इन दो डिपार्टमेंट्स के एम्प्लाइज (जोकि CDA पे-स्केल्स में थे) को BSNL में अब्सॉर्ब होने पर IDA पे-स्केल्स दिया जाना तय हुआ, और तब शुरू हुई ये पे-स्केल्स की लड़ाई।

DOT ने BSNL के JTO/JAO और SDE/AO के लिए स्टैण्डर्ड E1 और E2 पे-स्केल्स का प्रपोजल बनाया, जबकि BSNL के JTO/JAO और SDE/AO अपने लिए MTNL के JTO/JAO और SDE/AO के समान स्टैण्डर्ड E2 और E3 पे-स्केल्स की माँग कर रहे थे। DOT का मानना यह था कि BSNL के JTO/JAO और SDE/AO को MTNL के JTO/JAO और SDE/AO के समान स्टैण्डर्ड E2 और E3 पे-स्केल्स नहीं दिए जा सकते क्यूंकि MTNL के JTO/JAO और SDE/AO को स्टैण्डर्ड E2 और E3 पे-स्केल्स बिना पेंशन के दिए गए हैं, जबकि BSNL मे CCS Pension Rules 1973 के नियम 37A के तहत पेंशन देना तय हुआ है।

क्यूंकि BSNL के JTO/JAO और SDE/AO पेंशन छोड़ने को तैयार नहीं थे, तो बार्गेनिंग के बाद DPE ने BSNL के JTO/JAO और SDE/AO के लिए दो नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स लागू किये, जोकि स्टैण्डर्ड E1-E2-E3 पे-स्केल्स के मध्य के पे-स्केल्स थे। परन्तु DOT ने जब 2003 में प्रेसिडेंटिअल आर्डर जारी किया तो उसमे यह लिख दिया कि BSNL Recruited JTO/JAO और SDE/AO को भी नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स दिए जायेंगे। ये DOT की एक ऐतिहासिक भूल थी, जिसका SNEA और AIBSNLEA जैसे संगठनों ने कभी विरोध नहीं किया और जिसका नतीजा हम आज 18 सालों बाद भी भुगत रहे हैं। वास्तविकता ये है कि जब BSNL रिक्रूइटेड JTO/JAO और SDE?AO को पेंशन नहीं ही देनी थी, तो उनको 01.10.2000 से ही MTNL के JTO/JAO और SDE/AO के समान स्टैण्डर्ड E2 और E3 पे-स्केल्स दिया जाना था, न कि नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स। परन्तु SNEA और AIBSNLEA जैसे संगठनों ने BSNL में नए रिक्रूट हुए JTO/JAO साथियों को अँधेरे में रखा और आज भी रख रहे हैं।

फ़िलहाल, BSNL रिक्रूइटेड JTO/JAO और SDE/AO को पेंशन से कैसे वंचित किया गया, की सच्चाई अलग से बताई जाएगी।

अब समय आता है 2nd PRC का जो 01.01.2007 से लागू होनी थी, और जिसकी एक कंडीशन ये थी कि सभी नॉन-स्टैण्डर्ड पे-स्केल्स की जगह नए स्टैण्डर्ड पे-स्केल्स लागू किये जायेंगे। कानून की मर्यादा रखते हुए, कम से कम 01.01.2007 से तो स्टैण्डर्ड E2 और E3 पे-स्केल्स लागू कर ही देने चाहिए थे। परन्तु फिर पॉलिटिक्स खेली गई BSNL मैनेजमेंट तथा SNEA और AIBSNLEA जैसे संगठनों द्वारा। BSNL मैनेजमेंट ने DOT को प्रपोजल भेजा कि 01.01.2007 से BSNL के JTO/JAO और SDE/AO का नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स कम करके स्टैण्डर्ड E1 और E2 पे-स्केल्स कर दिया जाये। हैरानी की बात ये है कि SNEA और AIBSNLEA जैसे संगठनों ने इस प्रपोजल का भी विरोध नहीं किया।

01.01.2007 के बाद रिक्रूट हुए JTO/JAO की सैलरी नए स्टैण्डर्ड E1 पे-स्केल्स में फिक्स की गई (जोकि नॉन-स्टैण्डर्ड E1A पे-स्केल्स की सैलरी से भी कम थी), जिससे कोर्ट केस होने के बदल मंडराने लगे और आनन-फानन में BSNL मैनेजमेंट ने 01.01.2007 के बाद में रिक्रूट हुए JTO/JAO के लिए स्टैण्डर्ड E1 पे-स्केल + 5 इंक्रेमेन्ट्स की व्यवस्था लागू कर दी, जिसको SNEA और AIBSNLEA जैसे संगठनों ने खूब हवा दी, क्यूंकि उनके मेंबर्स को इस व्यवस्था से कोई हानि नहीं हो रही थी। तथ्य की प्रमाणिता के लिए आप चाहें तो SNEA और AIBSNLEA जैसे संगठनों की वेब-साइट्स खंगाल लीजिये और इनके द्वारा लिखे अनेक पत्र आपको मिल जाएंगे।

देर-सवेर मैंने AIGETOA में AGS रहते हुए BSNL मैनेजमेंट को यह समझा दिया कि स्टैण्डर्ड E1 पे-स्केल + 5 इंक्रेमेन्ट्स की व्यवस्था गैर-कानूनी है। इसको देखते हुए BSNL मैनेजमेंट ने 01.01.2007 से पुराने नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स के बदले नए नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स का प्रपोजल DOT को भेज दिया, किसको बाद मे न केवल DOT बल्कि DPE ने भी रिजेक्ट कर दिया और इस तरह BSNL मैनेजमेंट को मुँह की खानी पड़ी।

अब समय आता है 2010 जब BSNL मैनेजमेंट ने स्टैण्डर्ड E1 पे-स्केल + 5 इंक्रेमेन्ट्स की व्यवस्था को भी समाप्त कर दिया और इसके बाद रिक्रूट हुए JTO/JAO को मात्र स्टैण्डर्ड E1 पे-स्केल ही दिया गया। SNEA और AIBSNLEA जैसे संगठनों ने अभी भी स्टैण्डर्ड E2 पे-स्केल की मांग न करते हुए, स्टैण्डर्ड E1 पे-स्केल + 5 इंक्रेमेन्ट्स की व्यवस्था को लागू रखने की माँग जारी रखी।

अब समय आता है 2014 जिसमे BSNL मैनेजमेंट ने नए JTO Recruitment Rules 2014 लागू कर दिए और JTO के पे-स्केल को नॉन-स्टैण्डर्ड E1A पे-स्केल से कम करके स्टैण्डर्ड E1 पे-स्केल्स कर दिया। SNEA और AIBSNLEA जैसे संगठन अभी भी शांत बैठे रहे, कोई नोटिस नहीं, कोई स्ट्राइक नहीं, कोई धरना नहीं, क्यूंकि उनके मेंबर्स को तो कोई फर्क नहीं पड़ रहा था। हाँ, AIGETOA ने मुझसे कंसल्ट करके जरूर एक केस फाइल किया था, लेकिन उसमे भी मात्र JTO Recruitment Rules 2014 के प्रावधानों को retrospective date से लागू करने को चैलेंज किया गया था। इस केस में आगे क्या हुआ मुझे कोई जानकारी नहीं है।

BSNL मैनेजमेंट की हठधर्मिता और SNEA और AIBSNLEA जैसे संगठनों की धूर्तता को देखते हुए 2015 मे तब के GS AIGETOA श्री राम प्रताप शाहू जी में मुझे AIGETOA की ओर से Chandigarh CAT मे स्टैण्डर्ड पे-स्केल्स पर केस फाइल करने को बोला। 2016 मे जब केस Chandigarh CAT मे विचाराधीन था तो DOT ने एक लेटर निकला कि BSNL के पे-स्केल्स के मुद्दे को 3rd PRC को रेफेर कर दिया जाये। परन्तु Chandigarh CAT ने DOT के इस लेटर को न मानते हुए DOT को 2 महिनों में 01.01.2007 से नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स को बदलने का प्रेसिडेंटिअल आर्डर निकलने का आदेश दिया और 3 महीनों में वेतन का बकाया देने का आदेश दिया।

इस तरह हमने DOT को प्रेसिडेंटिअल आर्डर निकालने पर विवश किया, जिसको DOT पिछले 10 सालों से नहीं निकाल रहा था। 28.03.2017 को कोर्ट की अवमानना से बचने के लिए DOT ने हठधर्मिता पर उतरते हुए जानबूझ कर पुराने नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स के बदले 01.01.2007 से नए नॉन-स्टैण्डर्ड E1A और E2A पे-स्केल्स लागू करने का प्रेसिडेंटिअल आर्डर निकाल दिया, जोकि DPE के 2nd PRC आदेशों का खुलमखुला उलंघन है। और DPE ने भी DOT द्वारा निकले गए 28.03.2017 तारीख के प्रेसिडेंटिअल आर्डर की निंदा की है।

DOT द्वारा निकले गए 28.03.2017 तारीख के प्रेसिडेंटिअल आर्डर को AIGETOA के आर्थिक सहयोग से Chandigarh CAT मे चैलेंज कर दिया गया है और मैं आप सब को विश्वास दिलाना चाहता हूँ कि न केवल स्टैण्डर्ड E2 और E3 पे-स्केल्स को 01.01.2007 से लागू करवाया जायेगा, बल्कि वेतन की बकाया राशि पर बनता ब्याज भी दिलाया जायेगा।

मित्रो अब तक आप जान गए होंगे कि SNEA और AIBSNLEA जैसे संगठनों ने मात्र BSNL Absorbed Executives के लिए ही काम किया है और BSNL Recruited Executives को मात्र अपने फायदे के लिए उपयोग किया है, जिसका उल्लेख मैं BESA के 16.11.2018 के पत्र में भी कर चुका हूँ और मैंने कहा था कि AUAB के बैनर के निचे BSNL Recruited Executives को मात्र धोखा ही मिलेगा और हुआ भी वही जिसका डर था। माननीय मंत्री जी के साथ हुई मीटिंग के मिनट्स मे स्टैण्डर्ड E2 और E3 पे-स्केल्स का कोई उल्लेख नहीं है और ना ही 2nd PRC के बकाया मुद्दों का कोई उल्लेख है।

अब हमें स्टैण्डर्ड E2 और E3 पे-स्केल्स पर किसी के रहमोकर्म की आवश्यकता नहीं है, DOT अब Chandiharh CAT मे बुरी तरह से घिर चूका है और अब उसके पास स्टैण्डर्ड E2 और E3 पे-स्केल्स लागू करने के सिवाए कोई चारा नहीं है। क्यूंकि अब ये मुद्दा कोर्ट से सुलझने वाला है तो SNEA और AIBSNLEA के लोगों में क्रेडिट लेने की होड़ लगी हुई है, जबकि इन लोगों ने स्टैण्डर्ड E2 और E3 पे-स्केल्स को कभी भी सीरियस नहीं लिया।

अब मेरी आपसे एक ही विनम्र विनती है कि नक्कालों को पहचानो और इनके संगठन को छोड़ ईमानदार और कर्मठ संगठन BESA को सहयोग दो ताकि आपकी समस्याओं का जल्द निवारण हो सके।

Dear Friends,
Whatever development has taken place in AUAB's Strike was already fixed... Please refer our letter dated 16.11.2018, wherein we already told that 4G is mere an eyewash, whereas the real issue is 3rd PRC... AUAB (unfortunately AIGETOA is also part thereof) wants 3rd PRC without resolving the pending issues of 2nd PRC... The gist of pending issues of 2nd PRC have been numbered in our letter dated 16.11.2018... AUAB, the representative of BSNL Absorbed employees, wants to oppress the existence BSNL Recruited employees... AUAB has in principle agreed for 3rd PRC with the condition that Allowances and Retirement Benefits will remain as per pre-revised pay... If it is the case, who will be loser??? Only BSNL Recruited Employees will be loser because the pension of BSNL Absorbees depends upon basic that is going to be revised as per 3rd PRC... Thus, BSNL Absorbees will happliy retire leaving behind loans and losses for BSNL Recruited Employees... Therefore, there is no reason to allign with AUAB which is exclusively working for BSNL Absorbees... Had AUAB/SNEA/AIGETOA/AIBSNLEA/BSNLEU ever worked for unity, they would have never allowed E2/E3 been dragged for more than 12 years... Now, E2/E3 is pending before Hon'ble Chandigarh CAT, where DOT is in deadlock because it issued PO dated 28.03.2017 in stringent violation of DPE's 2rd PRC OM. An another question is why are AUAB/SNEA/AIGETOA/AIBSNLEA/BSNLEU not taking up the issue of multi-crores fraud committed in Post Employment Medical Benefits Fund (PEMBF)... Freinds, the PEMBF (exclusively meant for BSNL Recruited Employees) has not been yet created in stringent violation of Companies Act 1956/2013... Whereas, the medical benefits to the employees retired under Rule 37A have been paid by BSNL for 18 years out of current earnings though these employees are covered by CGHS... BESA pledges to take up all the matters of 2nd PRC in rational and judicious manner at appropriate platform...

BESA writes to Secretary DOT, CMD & Director HR for not to implement 3rd PRC

BESA writes to Secretary DOT, CMD & Director HR for not to implement 3rd PRC unless and otherwise the following pending issues of 2nd PRC are resolved -

  1. BSNL has withheld many benefits as implemented by 2nd PRC such as LTC, Medical and Perks. 
  2. BSNL is yet to pay the arrears of pay with 78.2% fitment as implemented by 2nd PRC w.e.f. 01/01/2007. Notably, the same seems to have been paid in MTNL at the directions of Hon’ble Bombay High Court. 
  3. BSNL has misutilised the corpus of Post-Employment Medical Benefit Fund (which was meant for the benefits of BSNL Recruited Employees) by paying-out medical reimbursements to ineligible retirees, who retired under Rule 37A of CCS Pension Rules 1972 and were factually covered by CGHS. Notably, BSNL and DOT are jointly and severally responsible for this debacle; and thus, yet to make this loss good since 01/10/2000. 
  4. BSNL is yet to implement the replacement of E1A and E2A Pay Scales within the purview of 2nd PRC w.e.f. 01/01/2007. 
  5. BSNL is yet to take ‘Year-On-Year Basis’ decision on 30% Superannuation Benefits for BSNL Recruited Executives as implemented by 2nd PRC w.e.f. 01/01/2007. 
  6. Above all, the present liquidity position of BSNL is beyond your knowledge. 
BESA also doesn't support AUAB for their agitational program as they are taking up the issues of BSNL Recruited Employees just for the name sake and will compromise everything for 3rd PRC and Pension Revision.

All India Conference at Rohtak
BESA organised its All India Conference at Rohtak under patronage of our chief guest Shri R.P. Shahu. Distinguished Guests from AIGETOA Shri Ravi Shil Verma GS AIGETOA, Shri Neelmani Yadav Ex CS UP West AIGETOA, Shri P.N. Sharma CS AIGETOA Rajasthan, Shri Ajit Kumar Ex CS AIGETOA Himachal and Shri Vivek Saxena DS SNEA Bareli also graced the occasion with their presence and valuable input. The issues concerning BSNL Recruited Executives were discussed and resolved to take up at appropriate forum within time frame manner. The conference begin with Deep Prajalwan by our Chief Guest Sh. R.P. Shahu. The Welcome speech given by All India President Shri Rajeev Kumar and he explained the need and role of BESA at this critical juncture of time for BSNL Recruited Executives. Shri Viveak Saxena DS Bareli also share his valuable inputs for welfare and progress of BSNL Recruited Executives and whole heartedly joined BESA. Our Chief Guest and founder member of BESA Shri R.P. Shahu addressed the house and in his detailed speech he give his valuable inputs for progress of BESA.
Shri Surinder Mahar GS BESA apprised of the objectives of BESA. He explained how BSNL Absorbed Executives have hands in gloves with Redeployed ITS Officers to drain-out the funds of BSNL. He explained that BSNL Absorbed Executives after their retirement (i.e. Rule 37A Retirees) and Redeployed ITS Officers are not at all eligible for BSNLMRS. The Post-Employment Medical Benefits (PEMB), being part and parcel of 30% Superannuation Retirement Benefits, are meant only only for BSNL Recruited Executives. Whereas, PEMB are being wrongfully and illegally paid by BSNL to Rule 37A Retirees since 01-10-2000, whereas Rule 37A Retirees, being Government Pensioners, are eligible only for CGHS. Similarly, Redeployed ITS Officers, being in CDA scales, are eligible only for CGHS. The other issues also he explained are in objectives of BESA.

Post Employment Medical Benefit Trust


BESA writes to Secretary DPE, Secretary DOT and BSNL for the violation committed by BSNL in providing Post Employment Medical Benefits (PEMB). Presently, BSNL is providing PEMB to ineligible employees, who are getting Pension under Rule 37A of CCS Pension Rules 1972 and Medical Benefits under CGHS. As per DPE OMs issued from time to time, the employees who are covered by Pension and CGHS cannot avail PEMB. Therefore, the Corpus meant for the welfare of BSNL Recruited Executives is misutilised by BSNL for BSNL Absorbed Executives. Further, BSNL is also providing PEMB out of its current earnings and without creating Trust in violation of Ind AS 19 issued under The Companies (Indian Accounting Standards) Rules, 2015.

Dear Members, BESA is committed for the implementation of 30% Superannuation Benefits for BSNL Recruited Executives; and creation of PEMB Trust is first step towards it.

Contempt Application (SDE to DE/AGM Promotion Case) before Hon'ble Chandigarh CAT

The Contempt Application (SDE to DE/AGM Promotion Case) filed by Mr. Ramesh Kumar Nehra DS SNEA before Hon’ble Chandigarh CAT against BSNL Management was heard today. However, BSNL’s Counsel has wrongly averred that proceedings before Hon’ble Chandigarh CAT have been stayed by Hon’ble Punjab and Haryana High Court. Whereas, Counsel of Mr. Ramesh Kumar Nehra vehemently denied this fact. To the best of knowledge of this association, there is no such stay granted either by Hon’ble Punjab and Haryana High Court or Hon’ble Supreme Court. Now, the matter is posted for 13-08-2018 as Constitutional Bench of Hon’ble Supreme Court is likely to hear on 03-08-2018 whether M.Nagaraj’ Case needs to be reviewed or not?

Mrs. Sujata Ray, Director (HR) BSNL has filed an MA seeking exemption from Personal Appearance before Hon'ble CAT Chandigarh. Pertinently, Mr. Ramesh Kumar Nehra, DS SNEA Rohtak filed a Contempt Application against CMD and Director (HR) for disobeying the direction given by Hon'ble CAT Chandigarh on 27/06/2018 that Reservation in Promotion not to be followed (M.Nagaraj's Case) and Catch-up Rules be applied (B.K.Pavitra's Case) while making promotion in the cadre of DE/AGM.
